Terms of Service

Sume is an AI creative platform for marketing teams and developers. Sume Agents let you brief an agent in chat, attach references, connect a brand, and receive images, videos, avatar videos, speech, and other media in return. Sume also offers Studio generation surfaces, Formats — reusable generation recipes you run with your own inputs, both Formats published by Sume and Formats you create where that feature is available to you — an asset library, scheduled runs and automations, shared workspaces for teams, a developer dashboard for API keys, webhooks, usage, jobs, concurrency and billing, a public API, and a remote MCP server and CLI for connecting Sume to your own agents and tools. Sume may add, remove, suspend, or modify features as the platform evolves.

You need an account to use most of the Services. Sume uses Clerk as its authentication provider and currently offers Google and GitHub sign-in. If you use Google Sign-In, you authorize Sume and its authentication provider to use the basic Google account information needed to create or access your account and maintain secure sessions. You are responsible for keeping your account, sessions, API keys, MCP authorizations, and credentials secure, and for all activity under your account. Sume also supports shared workspaces: if you create or join an organization, its administrators manage membership, roles, access, and billing, and content created in that workspace is visible to other members according to their role. When you invite someone, you confirm that you are allowed to share their email address with Sume for that purpose and that you are authorized to add them to the workspace.

Sume Agents act on your account and on your instructions. An agent may fetch public web pages you point it at, read and mirror product information from a brand website you connect, create media, draft an email and send it to the primary email address on your account after you approve it, and run again later on a schedule you configure through scheduled runs or automations. Scheduled and automated runs can start work, call generation models, and consume credits when you are not present. You are responsible for the instructions you give an agent, for the schedules and automations you enable, and for the results produced. Agent behavior is probabilistic and may deviate from your intent; review output before you rely on it.

You may connect a brand by giving Sume a public website URL. Sume then fetches publicly reachable pages from that site and may store product titles, descriptions, page URLs, and copies of product images so agents can reuse them. You may also point an agent at other public URLs, including competitor pages and public social media posts, and import public media by URL. You represent that you are permitted to connect the sites you connect, that you have the rights needed to use the material Sume retrieves on your behalf, and that your use complies with the terms and policies of the sites involved and with applicable law. Sume does not ask for, and you must not supply, credentials to sites you are not authorized to access.

You retain ownership of prompts, scripts, product images, uploaded files and attachments, voice input, URLs, likenesses, references, brand assets, Format definitions you author, and other content you submit to the Services. You grant Sume the rights needed to host, process, transmit, display, store, reproduce, and create outputs from your content to provide, secure, support, and improve the Services. You represent that you have all rights and permissions needed for the content you submit, including permission to use any person's likeness or voice.

Subject to your compliance with these Terms and applicable law, Sume does not claim ownership of generated outputs created for your account, and paid plans include commercial use as described on the pricing page. You are responsible for reviewing outputs before publication, distribution, or commercial use. Generated outputs are synthetic, may be inaccurate, unexpected, incomplete, offensive, or unsuitable for a particular use case, and should not be treated as professional advice or as a factual record of real people or events.

Sume offers a free plan and paid subscription plans. Self-service paid plans are billed on a recurring basis through Stripe, our payment processor, and you can manage or cancel a subscription from the dashboard. Enterprise services may instead be governed by an Order Form or other written agreement signed by you and Sume. That agreement may establish alternative payment methods, billing schedules, commitments, credit treatment, currency handling, plan changes, renewals, or expiration terms. If its commercial terms conflict with these Terms, the signed agreement controls for those services. Each plan includes a prepaid generation allotment for media jobs, a prepaid agent allotment for agent work, and a concurrency limit; current plans, prices, and allotments are shown on the pricing page and in the dashboard. Generation and agent usage draw down the matching balance, and work may be declined when a balance is exhausted. You can also buy additional prepaid credits where Sume offers them; purchased credits apply to your account or organization balance and carry no cash value outside the Services. You are responsible for charges incurred by your account, organization, API keys, agents, and scheduled runs. Except where required by law or expressly stated by Sume, fees and consumed credits are non-refundable.

Generation costs money, so Sume asks agents to confirm spend before running paid work. You choose how that works in your settings: approve every generation before it runs, approve automatically up to a dollar threshold you set, or let runs proceed without approval. Whichever mode you select, and any threshold you set, is your authorization for the resulting spend, including spend by scheduled runs and automations that execute while you are away. Review these settings before enabling unattended runs. Estimates shown before a run are estimates, and actual usage may differ.

The Services may be unavailable, delayed, rate limited, degraded, or changed from time to time. Plans include concurrency limits that cap how many generation jobs run at once. Agent runs and generation workflows depend on infrastructure and third-party services outside Sume's control. Sume does not guarantee that every request will be accepted, completed, or produce a usable result.

Sume uses third-party service providers for authentication and organization management, hosting, databases, payments, analytics, error monitoring, infrastructure, transactional email, media storage and delivery, sandboxed execution for agent tooling, and AI generation. The current categories and named providers are listed in the Privacy Policy. Your use of the Services may be subject to additional third-party terms where applicable, including the terms of any MCP client you connect and of any website an agent retrieves on your behalf. Sume keeps internal model routing and workflow details private and exposes Sume-owned product contracts to users.

Sume and its licensors own the Services, including software, systems, interfaces, agent tooling, documentation, trademarks, logos, and other materials we provide. These Terms do not grant you any rights to Sume intellectual property except the limited right to use the Services as permitted by these Terms.

You may stop using the Services at any time. Sume may suspend or terminate access if you violate these Terms, create risk for the Services or other users, fail to pay amounts due, or if required by law. Some provisions, including those relating to payment, ownership, disclaimers, liability, and dispute handling, survive termination.

The Services are provided "as is" and "as available" without warranties of any kind to the maximum extent permitted by law. Sume does not guarantee uninterrupted availability, error-free operation, provider availability, or fitness for a particular use. To the maximum extent permitted by law, Sume will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from your use of the Services.
